FRUITPORT CHARTER TOWNSHIP BOARD OF TRUSTEES
PROPOSED MEETING MINUTES OF JULY 27,   2009           

A work session of the Fruitport Charter Township Board began at 6:30 p.m. on Monday, July 27, 2009, in the township board room. 

Members Present:  Brian Werschem, Supervisor;  Rose Dillon, Treasurer;  Carol Hulka, Clerk;  Trustees:   Ron Becklin, David Markgraf, Marjorie Nash, and Chuck Whitlow.  Members Absent:  None 

At 7:00 p.m., Supervisor Werschem opened the meeting with the Pledge of Allegiance and a prayer.

Also Present:   7-township residents, 1-employee,  FAN reporter,Wiggins, planning Commissioner Larson, and Attorney Ron Bultje 

The board meeting minutes of July 31, 2009—regular meeting—were approved, as presented. 

The meeting agenda for June 8, 2009, was approved, as presented.

 UNFINISHED BUSINESS   
09-95  Public Hearing for Private Road Maintenance—2829 to 2940 DeVowe Road
      (a.)   The motion by Rose Dillon, seconded by Chuck Whitlow, was carried unanimously, to open the public hearing  
       at 7:10    7:10   p.m. in order to hear any objections to the private road maintenance and to the special assessment district
       proposed.

     (b.)    Discussion on road maintenance.  Property owners voicing their concerns were: 
      1.  Norman Gee, 2849 DeVowe Road, Muskegon, stated that he is against the proposed maintenance
      2.  Steve Nelson, 2871 DeVowe Road, Muskegon, asked questions concerning cost

     (c.)    The motion by Rose Dillon, seconded by Dave Markgraf, was carried unanimously, to close the public hearing at 
      7:25   p.m. for private road maintenance on DeVowe Road—2829 to 2940 DeVowe.

09-96  Resolution #3—Setting up Special Assessment District for 2829 to 2940 DeVowe Road  
Rose Dillon moved, Marjorie Nash seconded, MOTION CARRIED, to adopt Resolution #3, which authorizes procedure to set up a special assessment district for private road maintenance on DeVowe Road, from 2829 to 2940 DeVowe.

 Ayes:  Dillon, Nash, Becklin, Whitlow, Markgraf, Hulka, Werschem     Nays: none 

09-97  Resolution #4—Setting Hearing Date for Private Road Maintenance for 2829 to 2940 DeVowe Road
Rose Dillon moved, Ron Becklin seconded, MOTION CARRIED, to adopt Resolution #4, which sets the hearing date for confirmation of the special assessment district for DeVowe Road, from 2829 to 2940 DeVowe.  The hearing date is August 24, 2009.

Ayes: Dillon, Becklin, Whitlow, Markgraf, Hulka, Werschem, Nash      Nays:  none

09-98  Public Hearing for Private Road Maintenance—for 2856 to 2956 DeBaker Road
       (a.)    The motion by Chuck Whitlow, seconded by Dave Markgraf, was carried unanimously, to open the public hearing
        at 7:27 p.m. in order to hear any objections to the private road maintenance and to the special assessment district
        proposed.
 

      (b.)    Discussion on the road maintenance.  Property owners voicing their concern were:

      1.       Linda Gyori, 2872 DeBaker Road, Muskegon,  had questions and comments
     
2.       Victor Covell, 2872 DeBaker Road, Muskegon, asked questions concerning costs

     (c.)     The motion by Chuck Whitlow, seconded by Dave Markgraf, was carried unanimously, to close the public hearing at 8:11 p.m. for private road maintenance for 2856 to 2956 DeBaker Road. 

09-99  Resolution #3—Setting up Special Assessment District for 2856 to 2956 40 DeBaker Road
Rose Dillon moved, Marjorie Nash seconded, MOTION CARRIED, to adopt Resolution #3, which authorizes procedure to set up a special assessment district for private road maintenance on DeBaker Road, from 2856 to 2956 DeBaker. 

Ayes: Dillon, Nash, Becklin, Whitlow, Markgraf, Hulka, Werschem,      Nays: none  

09-100  Resolution #4— Hearing Date for Private  Road Maintenance for 2856 to 2956 DeBaker
Chuck Whitlow moved, Rose Dillon seconded, MOTION CARRIED, to adopt Resolution #4, which sets the hearing date for confirmation of the special assessment district for DeBaker Road, from 2856 to 2956 DeBaker.  The hearing date is August 24, 2009.

Ayes:  Whitlow, Dillon, Werschem, Hulka, Markgraf, Becklin, Nash       Nays: none 

09-101  Public Hearing for Private Road Maintenance—for 3580 to 3595 Sheringer Road
       (a.)    The motion by Chuck Whitlow, seconded by Ron Becklin, was carried unanimously, to open the public hearing at  
        8:13 p.m. in order to hear any objections to the private road maintenance and to the special assessment district       
        proposed.

               1.       Discussion on road maintenance.  One property owner was in the audience who will be affected by the road
                      maintenance.   Property owner,  Pamela Sowa, 3589 Sheringer Road, Muskegon, asked questions of concern

       (b.)   The motion by Dave Markgraf, seconded by Chuck Whitlow, was carried unanimously, to close the public hearing at
               8:57 p.m. for private road maintenance for 3580 to 3595 Sheringer Road.   
 

09-102  Resolution #3—Setting up Special Assessment District for 3580 to 3595 Sheringer Road 
Chuck Whitlow moved, Rose Dillon seconded, MOTION CARRIED, to adopt Resolution #3, which authorizes procedure to set up a special assessment district for private road maintenance on Sheringer Road, from 3580 to 3595 Sheringer.
 

Ayes:  Whitlow, Dillon, Werschem, Hulka, Markgraf, Becklin, Nash        Nays: none 

09-103  Resolution #4— Hearing Date for Private Road Maintenance from  3580 to 3595 Sheringer David Markgraf  moved, Chuck Whitlow seconded, MOTION CARRIED, to adopt Resolution #4, which sets the hearing date for confirmation of the special assessment district for Sheringer Road, from 3580 to 3595 Sheringer.  Hearing date is August 24, 2009. 

Ayes: Markgraf, Whitlow, Becklin, Nash, Dillon, Werschem, Hulka       Nays: none 

NEW BUSINESS

09-104  Enterprise Funds – Rent & Administration
Chuck Whitlow moved, Rose Dillon seconded, MOTION CARRIED, to set rent and administrative fees on actual costs, amend the current fiscal year budget to reflect the same, and authorize the Treasurer to prepare and execute the appropriate adjusting journal entries effective April 1, 2009, as recommended by DPW Committee. 

Ayes:  Whitlow, Dillon, Nash, Becklin, Markgraf, Hulka, Werschem    Nays  none: 

09-105  Closed Session to Discuss Great Lakes Downs Racing Litigation

      (a.)   Chuck Whitlow moved, Ron Becklin seconded, MOTION CARRIED, to go into closed session at 8:03 p.m. to discuss
             confidential attorney correspondence regarding Great Lakes Downs Racing Litigation        

      Ayes:  Whitlow, Becklin, Nash, Dillon, Werschem, Hulka, Markgraf          Nays: none

     (b.)   The motion by Chuck Whitlow, seconded by Rose Dillon, was carried unanimously, to go back in open session at   
             8:30 p.m.

  09-106  Settlement--Great Lakes Downs Racing Litigation
Chuck Whitlow moved, Marjorie Nash seconded, MOTION CARRIED, to accept the settlement of $10,000 from MI Racing in settlement of the Great Lakes Downs Racetrack litigation.  

Ayes:  Whitlow, Nash, Becklin, Markgraf, Hulka, Werschem, Dillon   Nays:  none

 09-107    Payment of Bills
Marjorie Nash moved, Carol Hulka seconded, MOTION CARRIED, to approve bills for payment in the following amounts:  General Fund  $21697.16;  Public Safety $49,279.10;  Water $34,596.91;  Sewer $3,842.48;  Parks $ 2,869.14       Totaling $112,284.79 

Ayes: Markgraf, Hulka, Werschem, Dillon, Nash, Whitlow, Becklin            Nays: None
